Cambodia opens IP recordation system portal 

On September 14, 2024, Cambodia government introduces its new IP recordation system portal at a workshop held at the National Customs School. 2 weeks since then, it is now fully functional.

The system is available through the GDCE’s website (https://lnkd.in/g6UkZfSj)- which requires an authorized user account. At present, there is no official fee for the use of the recordation system. However, it is not fully comprehensive.

Specifically, trademarks, geographical indications and copyrights may be recorded with the system but patents, utility models and industrial designs are not yet incorporated. It remains to be seen in the future if these 3 types of IP will be recorded in the system.

In addition, it should be noted that the recordation is valid for the term of the IP right, for example 10 years since the filing date of a trademark application. Upon renewal of a trademark registration or exclusive rights distributorship, a new recordation will be necessary as the recordation system doesn’t automatically transfer the recording data to its renewal.

Lastly, there will be no official certificate or confirmation of recordation under the new system. Instead, the user will need to accept with the ‘accepted’ status of the request in the online system. There should be a 2 business days processing time.
