Denmark
As of July 1, 2023, the Danish Patent and Trademark Office will have made changes to the country’s intellectual property fee structure, with the changes affecting the publication and renewal costs for patents.
The publishing fee for patents has increased as of the implementation date from 2,000 DKK to 2,075 DKK, an increase of almost 4%.
The patent annuity payments have increased for each year by a comparable rate, with years one through three seeing an increase of 3% from 500 DKK to 515 DKK and years four through ten seeing an increase of around 4% from 2,300 DKK to 2,385 DKK. A 4% inflation rate has also been applied to the fifteenth and twentieth years, which have gone from 3,600 DKK to 3,740 DKK and 5,100 DKK to 5,295 DKK, respectively.
Any renewal fees already charged by the IPO prior to this date and payable up until September 30, 2023, will continue to be charged at the previous fee amount because the fee revisions are effective as of July 1st.
Iceland
A new schedule of intellectual property fees went into effect in Iceland on July 1, 2023. According to the amendments, a processing charge totaling 8,200 ISK has been introduced in connection with the notice of an exemption from Supplementary Protection.
In addition, a new clause has been introduced that permits a return of yearly fees paid in the event that a request for the re-establishment of rights is denied, making the annual costs unnecessary. Additionally, under the new conditions, any excess costs paid to the IPO may also be returned.
Switzerland
The Swiss Intellectual Property Office (IPI) has also modified several fees related to trademark registration and upkeep as of July 1, 2023.
The charge for filing a trademark with the IPI has decreased as of the aforementioned date by almost 18%, from 550 CHF to 450 CHF. Additionally, a 50 CHF discount has been applied to the charge for international trademarks identifying Switzerland in up to three classes.
Additionally, the Swiss IPI has instituted a 100 CHF e-discount for applicants who submit their applications electronically.
The trademark renewal fee will be reduced from 700 CHF to 550 CHF the following July 1, 2024, for an estimated 21% reduction.
The fee decrease adopted by the Swiss IPI follows a successful business fiscal year for the IP Office and is anticipated to encourage further filings in the jurisdiction.
Malaysia
The Malaysian Patent Registration Office formally launched the possibility of submitting patent applications electronically in the country via the online IP Portal on June 6, 2023.
As a result, applicants can use the country’s online site to file for patent protection, including PCT and PPH applications, as well as submit additional activities related to the protection and maintenance of a patent right.
The change aligns the jurisdiction with a more modern approach to patent filing, joining many worldwide counterparts in permitting electronic submissions and bringing the IP protection procedure one step closer to a greener, paperless future.
